Terms of Service
The terms between you and PT Suite Digital Media when you use Suite Qloud.
These Terms of Service form an important part of the relationship between you, as the Customer, and Suite Qloud, as the service provider. By registering a Suite Qloud account, you acknowledge that you have read and agreed to all Terms of Service set out in this document.
Users of Suite Qloud services must accept the following Terms of Service:
- We make no representation that the domain name you wish to register can be registered by you, for you, or in your name. You should not assume that a requested domain name has been registered until you are subsequently notified.
- The registration and use of your domain name are subject to the terms and conditions imposed by the relevant naming authority, including ICANN for .COM, .NET, and .ORG domains. You are not entitled to make any claim against us in connection with the rejection of a domain name registration. Any administrative fees paid to register your requested name are non-refundable, even if the registration is rejected by the naming authority.
- We are not responsible for your use of any domain name. Any dispute between you and another party must be resolved between the parties concerned. If such a dispute arises, we reserve the right, at our discretion and without providing any reason, to withhold, suspend, or cancel the domain name. We may also make representations to the relevant naming authority but are not required to participate in the dispute.
- We will not release a domain name to another provider unless full payment for that domain name has not been received by us. All fees payable by you for services must comply with the rates and prices published from time to time on our website and are due and payable in advance of our provision of the relevant services.
- Without prejudice to any of our other rights, if an invoice is not paid in full on or before its due date, we may immediately suspend your services, with or without notice.
- You agree to indemnify, defend, and hold us harmless against any breach by you of these terms and against any claim brought against us by a third party arising from our provision of services to you or your use of the services.
- If you breach any provision of these Terms of Service and fail to remedy the breach within seven (7) days after we provide written notice specifying the breach, we may terminate your Suite Qloud account and suspend your services, with or without further notice.
- If you are a company and enter liquidation due to insolvency, have an administrator or administrative receiver appointed, or enter into a voluntary arrangement with your creditors, we may terminate your Suite Qloud account and suspend your services, with or without notice.
- Upon termination of your Suite Qloud account or suspension of your services, we may immediately block your website and delete all data contained therein. We reserve the right to delete all data; however, at our discretion, we may retain such data for a period determined by us to allow you to retrieve it at your own expense, subject to full payment of all amounts due to us.

Unless the complainant provides evidence of legal action (litigation or an official request from the competent authorities) within a reasonable period, the content may be restored and made accessible again at Suite Qloud's discretion.
- Users who use Suite Qloud services for voice communications acknowledge that Suite Qloud is not a telecommunications service operator under applicable laws and regulations and must not be regarded or treated as a voice communications provider. - If a service interruption is clearly proven to have resulted from negligence or a technical error attributable to Suite Qloud, Suite Qloud's liability is limited to refunding the service subscription fees paid by the User for the period affected by the interruption, not exceeding the amount paid.
- The User expressly waives the right to bring any further claim, demand, or request for compensation beyond the liability limit stated above. The User understands that the services are provided on an “as is” and “as available” basis.

However, the User understands and agrees that, in certain circumstances, Suite Qloud may be restricted or prohibited by law or an order of a competent authority from notifying the User of the disclosure of information or Personal Data. In such cases, the User expressly releases Suite Qloud from any notification obligation and any resulting legal liability.
- Suite Qloud is committed to protecting the security and confidentiality of Users' Personal Data in accordance with the principles set out in Government Regulation No. 71 of 2019 on the Implementation of Electronic Systems and Transactions and Law No. 27 of 2022 on Personal Data Protection. During the force majeure event, Suite Qloud's performance of its obligations will be suspended for the duration of the event.
- If a force majeure event continues for more than thirty (30) consecutive calendar days, either party may, by mutual agreement, review whether the service or agreement should continue, without either party being subject to penalties or compensation in connection with discontinuation of the service.
Governing Law and Dispute Resolution
- All terms, conditions, policies, and uses of services provided by Suite Qloud are governed by and construed in accordance with the laws in force in the Republic of Indonesia.

Legal Compliance
- Customers are fully responsible for all operational matters and compliance with laws, regulations, rules, and requirements applicable in the country or jurisdiction where they conduct business or use Suite Qloud services.

Administration Fees
- An administration fee is a non-refundable fee charged to Customers to cover transaction processing, system maintenance, payment gateway integration, and the provision of services on the Suite Qloud platform.
- The administration fee may vary depending on the payment method selected by the Customer, the type of service, and the total transaction amount. The fee may be calculated as a percentage of the total invoice, a fixed amount per transaction, and/or an additional unique amount used to distinguish transactions for automated payment verification.
- Full details of the administration fee will be clearly displayed on the checkout page before the Customer confirms the payment. By proceeding with the transaction and making payment, the Customer is deemed to have read, understood, and agreed to all applicable fees.

Domains
Domain Registration
International Domains
- Domain name registration operates on a first come, first served basis. Customers may not hold Suite Qloud responsible if the domain name they wish to register has already been registered by someone else.
- The issuance of an invoice does not mean that the Customer owns the domain name.
- Domain registration is considered successful only when the Customer has paid the full amount stated on the invoice and the invoice status is marked as paid; the Customer has submitted all required documents for domains that require supporting documentation and/or clicked the domain activation confirmation email; and the domain has been successfully registered in the Customer's name, as verifiable through the WHOIS database at https://suiteqloud.com/domain/whois/.
- Customers may select a domain registration term ranging from one (1) to ten (10) years.
- Suite Qloud reserves the right to suspend domain names that infringe copyright or are associated with pornography, phishing, spam, scams, or similar activities.
- A domain name purchased and paid for by a Customer cannot be replaced with another domain name. If the Customer wishes to change the domain name, the Customer must purchase a new domain name.
- Suite Qloud is not responsible if a domain name is registered by another party because the Customer delays payment of the registration invoice.
- Customers must comply with the rules established by the relevant Domain Registrar, including rules concerning domain name use, WHOIS information, and related matters.
- Customers are prohibited from misusing Domain Contact details (Owner or Registrant, Administrative, and Billing) by using another person's name or identity without that person's permission.
- Suite Qloud is not responsible for registered domain names that are subsequently flagged, blocked, or included in third-party lists or monitoring services, including but not limited to TrustPositif+ Komdigi (https://trustpositif.komdigi.go.id/), Spamhaus, Registrar/Registry lists, and similar databases.
Indonesian Domains
- By registering an Indonesian domain, the registrant is deemed to understand the Indonesian Domain Name Policy available at https://pandi.id/regulasi/.
- By acknowledging the Indonesian Domain Name Policy, the registrant agrees to accept all consequences arising from registering a domain name that does not comply with that policy, including legal and financial consequences.
- The registrant releases the Provider, Registrar, and PANDI from all consequences borne by the registrant arising from the registration and use of the domain name, including consequences resulting from a domain name that does not comply with the Indonesian Domain Name Policy.
- The registrant grants or acknowledges the following rights and obligations:
- a. The registrant acknowledges and accepts that PANDI and the Registrar may process, copy, publish, modify, and make Personal Data available through the WHOIS service, and may authorize third parties to do the same, in accordance with applicable data protection rules and laws;
- b. The registrant must comply with the rights-protection mechanisms, procedures, and processes established under the Domain Name Policy;
- c. The registrant must comply with decision-making procedures under the Uniform Domain Name Dispute Resolution Policy (UDRP) or those of another judicial body having jurisdiction over PANDI, the Registrar, or the Provider;
- d. The registrant must update domain name information whenever any relevant information changes, on a lawful basis;
- e. The Registrar and PANDI are entitled to carry out processes and procedures to prevent infringement of intellectual property rights in the registrant's second-level domain (SLD);
- f. The Registrar is entitled to amend and/or adjust the Domain Name Policy and any required procedures before implementation and during the operation of the rights-protection mechanisms established by PANDI;
- g. The registrant warrants that the Provider, Registrar, and PANDI shall not be responsible for any loss arising from the revocation, suspension of activation, or other action taken against a domain name to enforce a court or arbitration decision, or a decision by another legally authorized institution empowered to require the Provider, Registrar, or PANDI to implement that decision;
- h. The information entered by the registrant in the domain name registration form and/or domain contact management form must be true, legally verifiable, and relevant to ownership and naming of the domain name;
- i. The registrant warrants that documents uploaded as requirements for domain registration are valid and that their existence and authenticity can be verified; and
- j. The registrant understands that approval of a domain name registration does not constitute a legal entitlement and remains subject to the Domain Name Policy and applicable laws and regulations.
- Auto-Activation Feature
- Suite Qloud implements a temporary auto-activation feature for registrations of domains requiring supporting documentation, such as Indonesian domains .co.id, .or.id, .ac.id, .sch.id, .ponpes.id, and .web.id. Such domains will be temporarily activated automatically after the Customer has paid the invoice, provided the domain has not already been registered by another party.
- The auto-activation process is as follows:
- Day 1: The domain is temporarily activated, and the Customer receives an email requesting the required documents.
- Days 1–3: The Customer may upload the required documents.
- Day 4: If the Customer has not uploaded the required documents, or if the uploaded documents are rejected, the Customer receives another email requesting the documents and warning that the domain will be suspended.
- Day 5: The Customer's domain is suspended.
- Days 14 and 21: The Customer receives further emails requesting the required documents.
- Day 30: The domain is deleted if the Customer has not uploaded the required documents or if the submitted documents have been rejected.
- No refund will be provided for a temporarily auto-activated domain if the Customer fails to complete the documentation in accordance with the applicable requirements.
Premium Domains
- If a domain name submitted by a Customer for registration is classified as a premium domain, the status and price of which can only be confirmed after checking and submitting the request through the Registrar's system, Suite Qloud reserves the right to cancel the order for that domain name.
- Suite Qloud will promptly inform the Customer that the domain is premium and provide the actual price set by the Registrar. If the Customer does not accept the stated price or does not wish to proceed at that price, all funds paid for the domain order will be refunded in full.
- The Customer agrees that a domain purchase transaction is not final or binding until the Registrar officially confirms the domain price. The Customer also understands and agrees that Suite Qloud has no authority to set prices for premium domains, as pricing is determined exclusively by the Registrar.
Domain Renewal
- Suite Qloud is not responsible for the loss of domain ownership resulting from a Customer's failure to renew the domain within the period provided.
- Domain renewal terms are available only for periods ranging from one (1) to nine (9) years.
- Customers who registered a domain for a ten (10)-year term may renew it for a maximum term of nine (9) years.
- A domain will enter a thirty (30)-day grace (expired) period, during which the standard renewal price displayed on the Suite Qloud website applies.
- After the grace (expired) period, the domain enters a further thirty (30)-day expired period, also known as the Redemption Period. If the Customer still wishes to renew the domain, a redemption fee will be charged in addition to the domain renewal price.
- The high redemption fee is set by the Registry (the organization responsible for managing a particular TLD, such as ICANN for .com, .net, and .org, or PANDI for .id). The Registrar passes this fee on to the Customer. The fee is intended to encourage domain owners to renew on time and avoid the risk of losing their domain ownership.
- During the Redemption Period, the Registrar may auction, sell, or transfer the domain to a third party. Suite Qloud cannot prevent such action or recover a domain acquired by a third party during the Redemption Period.
- Suite Qloud cannot renew a domain that has passed the Redemption Period. If the Customer wishes to register the domain name again, the Customer must wait until it becomes available. Suite Qloud is not responsible for monitoring when the domain may become available again and does not guarantee that the Customer will be able to register it again.
- If a system failure prevents a domain from being renewed and the Customer does not contact Suite Qloud, we are not responsible if the domain is acquired by a third party.
- Customers may not use a Suite Qloud email address as a Domain Contact (Owner or Registrant, Administrative, or Billing contact), because important domain information will be sent to the email address listed in the Domain Contact or WHOIS records.
Domain Transfers
- Customers may transfer a domain themselves through the Suite Qloud Dashboard using the applicable EPP code, after disabling WHOIS privacy protection and unlocking the domain to be transferred.
- A domain transfer requested outside the Suite Qloud Dashboard will be processed after Suite Qloud contacts the domain owner and obtains the owner's approval for the transfer.
- Suite Qloud is not responsible for domain transfer issues caused by the Customer's error or negligence.
- Domains suspected or proven to have violated these Terms of Service may not be transferred out of Suite Qloud.
Domain Name Suspension by a Registry
- If a Customer's domain name is suspended by a Registrar, Registry, or domain management authority (such as PANDI), the Customer understands and agrees that the suspension is solely within the authority and discretion of the Registrar, Registry, or relevant authority, in accordance with its rules and policies.
- Suite Qloud is not responsible for any loss, consequence, or impact arising from the suspension, deletion, or restriction of a domain name by the Registrar, Registry, or domain management authority as described above.
- At the Customer's request, Suite Qloud may assist with follow-up and/or communications with the Registrar, Registry, or domain management authority regarding the status of the domain or a request to lift the suspension. However, the Customer understands and agrees that Suite Qloud cannot guarantee that such a request will be approved or that the domain will be reactivated, as the decision rests solely with the relevant Registrar, Registry, or authority. Suite Qloud also cannot estimate how long the relevant party will take to lift the suspension.
Domain Name Disputes
- Suite Qloud is not responsible for any dispute, disagreement, or claim of rights between a Customer and a third party concerning a domain name, including disputes about ownership, use, or rights to the domain name.
- All domain name disputes, including but not limited to claims concerning the right to use or own a domain, must be resolved in accordance with the rules, procedures, and mechanisms established by the relevant Registrar, Registry, or authorized domain management authority.
- The Customer understands and agrees that, notwithstanding the dispute resolution provisions in these Terms of Service, domain name disputes will be resolved directly through the mechanisms and jurisdiction determined by the relevant Registrar, Registry, or authorized domain management authority, and not through Suite Qloud.
- Suite Qloud is not obligated to represent, assist with, or seek resolution of any domain name dispute between the Customer and a third party, whether in or out of court.

Service Lifecycle
Hosting (Cloud Hosting)
1. Service Active Period
If a Customer has not paid the renewal invoice, the hosting service will remain active until the sixth (6th) day after the due date (Next Due Date). During this period, the service will continue operating normally, and the Customer may still complete payment.
2. Service Suspension
If the Customer has not paid the renewal invoice by the seventh (7th) day after the due date, the hosting service will be automatically suspended. During the suspension period, the service cannot be accessed or used, but the Customer's data will remain securely stored.

If payment or renewal has not been made within thirty (30) calendar days after the due date, the service will be terminated. All data associated with the service will be permanently deleted and cannot be recovered, and the contractual relationship for that service will be considered ended. 4. Customer Responsibility
Customers are responsible for ensuring that renewal payments are made before the specified deadline. Suite Qloud is not responsible for data loss or service disruption resulting from late payment.

- An upgrade may be performed while the service is active and before the renewal invoice is issued.
- A service upgrade may be performed at any time, provided the service remains active.
- Cloud Hosting services cannot be downgraded.
Usage Restrictions
Usage restrictions are intended to maintain server and system stability so that all Customers' services operate properly. The restrictions for each service are set out below.
Cloud Hosting
Users may not run processes or applications that cause excessive or unreasonable use of resources (CPU, RAM, I/O, or MySQL), including but not limited to:
- Using more than 10% of system capacity (CPU/memory) continuously for more than sixty (60) seconds.
- Running resource-intensive scripts or processes, such as CGI, intensive FTP, large MySQL queries, or repeated HTTP processes that affect overall server performance.
- Running applications that require continuous requests per second or real-time communication, such as IoT applications, intensive API polling, bulk webhooks, or periodic monitoring systems. For these requirements, Customers are advised to use the Business Cloud Hosting plan.
- Running cron jobs at intervals of less than six (6) minutes. If more frequent cron execution is required, Customers should use the Business Cloud Hosting plan.
- Running interactive, real-time chat applications that require continuous server-side processing. Remote-host services are permitted.
- Using the service for Computer-Based Testing (CBT) or online examination applications, such as Moodle, Candy CBT, Sakai, or similar applications. CBT or online examination applications are permitted only on the Business Cloud Hosting plan.
- Using the service for social media marketing (SMM) websites, Payment Point Online Banking (PPOB), or similar applications that use a large number of cron jobs. Such applications are permitted only on the Business Cloud Hosting plan.
- Running unattended server-side daemon processes continuously is prohibited. This includes any service or application that runs continuously without direct user interaction or active monitoring.
- Operating automated bots, large-scale data scraping applications, third-party service emulators, or systems involving auto-refresh, auto-posting, or similar methods.
- Using the service to send email beyond the maximum permitted limit of one hundred (100) emails per hour per domain, whether for personal, promotional, or automated purposes.
Daily Backup Premium
Daily Backup Premium is an add-on service available with the Business Cloud Hosting plan.
- Daily Backup Premium performs backups every day, retaining backups for seven (7) days.
- Daily Backup Premium uses an incremental backup structure.
- Daily Backup Premium backups are available for seven (7) days, after which each daily backup is replaced by a new backup.
- Daily Backup Premium runs every day starting at 21:00 WIB and continues until completion.
- The disk capacity limit for Daily Backup Premium corresponds to the disk capacity of the subscribed plan.
- Data generated for download through Daily Backup Premium is stored on the server for a maximum of 2 × 24 hours from the time the download file is generated. It is then automatically deleted by the system.
Data Storage, Security, and Backups
- Customers are fully responsible for preventing the loss of or damage to data and content on their websites. Customers must independently create copies, archives, and backups to maintain the continuity and security of their data.
- Customers are also fully responsible for the confidentiality and security of all their data, including taking the necessary measures to prevent unauthorized access.
- Customers may create backups themselves through the hosting control panel. However, backups use storage space in the Customer's hosting account. To avoid excessive storage use, Customers are advised to download backup archives to local storage promptly and then delete them from the hosting account.
- Cloud Hosting is not designed to serve as a backup storage service. Accordingly, Suite Qloud has no responsibility or obligation for the loss of or damage to data, including backups created by the Customer, whether caused by force majeure, system failure, hardware failure, or any other cause.
- Suite Qloud provides one weekly backup and one monthly backup for specific circumstances, such as recovery from a server-side failure. These backups are not intended to replace the personal backups that Customers are required to maintain. Suite Qloud does not guarantee that these backups will always be available or complete.
- Backup data can only be retrieved while the hosting service is active. If the hosting service is suspended, it must first be reactivated.
- If the hosting service has been terminated, any available backup files will be retained for only ten (10) days from the termination date. If the service is not renewed within those ten (10) days, the backup will be automatically deleted by the system.
Service Level Agreement (SLA)
The Service Level Agreement (SLA) applies to Cloud Hosting services. If applicable, compensation will be provided by extending the active period of the affected service as follows:
- Above 99.9%: Guaranteed.
- 99.5%–99.89%: Ten (10) additional days of service.
- 99.0%–99.49%: Twenty (20) additional days of service.
- Below 99.0%: Thirty (30) additional days of service.
If a Suite Qloud service experiences issues that result in uptime below 99.9%, the total downtime calculation and applicable compensation will be provided in the following month. Claims may only be submitted in the following month and will be based on the previous month's uptime.
Customers must submit claims between the first (1st) and seventh (7th) day of the month following the monthly SLA calculation. All maintenance work is excluded from this guarantee and will not be counted. Uptime is calculated solely using our status page and monitoring systems.
